Welcome to Marcis King Music Productions (“we”, “us”, or “the Site”). These Terms and Conditions govern your purchase and use of digital music downloads (“Music”) from the Site. By purchasing or downloading any Music, you agree to be bound by these Terms. If you do not agree, do not purchase or download.
1. Licence Grant
Upon successful payment and download, the artist (as copyright owner) grants you a non-exclusive, non-transferable, revocable, personal licence to:
- Download the Music file(s).
- Store the Music on your personal devices.
- Play the Music for private personal use.
- Play the Music in a church setting for worship services and church-related social functions (e.g., fellowship events, community gatherings organised by the church).
This licence is limited strictly to the above uses. The Music remains the intellectual property of the artist at all times.
2. Restrictions
You may not:
- Copy, reproduce, distribute, sell, rent, lend, sub-license, or share the Music with any third party (except as incidental to permitted church use within the same congregation).
- Upload the Music to the internet, streaming services, social media, file-sharing sites, or any public platform.
- Use the Music for any commercial purpose, including background music in businesses, events with paid entry, advertising, podcasts, videos (unless purely for internal church worship recording not distributed publicly), films, or merchandise.
- Modify, remix, edit, or create derivative works from the Music.
- Perform or play the Music in public settings outside a church worship or social function (e.g., concerts, parties, retail, or online broadcasts).
- Remove or alter any copyright notices or watermarks on the files.
Any use beyond the permitted scope is a breach of copyright and these Terms.
3. Purchases and Refunds
All sales of digital downloads are final. Refunds are not available once the file has been downloaded, except in cases required by Australian Consumer Law (e.g., faulty files). We reserve the right to refuse or cancel orders.
4. Intellectual Property
All Music is protected by copyright. Nothing in these Terms transfers ownership or any rights other than the limited licence described. You must not challenge the artist’s copyright.
5. Termination
We may terminate your licence immediately if you breach these Terms. Upon termination, you must delete all copies of the Music.
6. Disclaimers and Liability
The Music is provided “as is” without warranties of any kind. We and the artists are not liable for any loss, damage, or injury arising from your use of the Music, except as required by law.
7. General
These Terms are governed by the laws of Victoria and the Commonwealth of Australia. We may update these Terms from time to time; continued use after changes constitutes acceptance.
By downloading Music from the Site, you confirm you have read, understood, and agree to these Terms and Conditions.
